1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the "Functional Aesthetics Consultation: Beauty From the Inside Out" booking funnel, calendar scheduling system, and related services offered through the collaborative partnership between Image District ("Image District") and Complete Health & Wellness ("Complete Health & Wellness"), together operating as CHW Functional Aesthetics (collectively "we," "us," or "our"). By booking a consultation or submitting your information, you agree to be bound by these Terms.

2. Nature of the Consultation

The Functional Aesthetics Consultation is a paid introductory session priced at $149 (promotional rate; regularly $299). It is a personalized, one-on-one consultation designed to review your aesthetic goals, skin concerns, hormonal and metabolic health indicators, and lifestyle factors, resulting in a customized plan built on the The HealthSpan Method™ wellness framework with a focused emphasis on body composition, weight optimization, and skin integrity.

This consultation is not a comprehensive medical examination and does not establish a full patient-provider relationship with Complete Health & Wellness. A formal clinical relationship is established only upon completion of full intake documentation and acceptance as a patient by our physician. Image District services are aesthetic in nature and do not constitute medical care.

3. The Partnership Model

Image District focuses on aesthetic treatments and enhancements. Complete Health & Wellness provides the functional medicine and clinical wellness components. This collaboration allows both entities to offer an integrated "inside-out" approach. Each entity operates independently and is separately responsible for its own services, staff, and professional obligations.

By booking through this funnel, you acknowledge that your consultation may involve representatives and/or clinical staff from one or both partner entities, and that your information may be shared between them for the purpose of delivering your consultation and personalized plan (see Privacy Policy, Section 3).

4. Consultation Fee, Payment, and Refund Policy

Fee

The consultation fee is $149 (promotional rate; regularly $299). Payment is collected at the time of booking to reserve your time slot.

  • Cancellations made at least 48 hours before your scheduled appointment are eligible for a full refund or free reschedule.

  • Cancellations made less than 48 hours before your appointment may be subject to a cancellation fee of up to the full consultation amount.

  • No-shows (failure to appear without prior notice) will not be refunded.

  • If we cancel or need to reschedule your appointment for any reason, you will receive a full refund or complimentary reschedule at your option.

Refund requests must be submitted to [email protected] with your booking confirmation number.

5. Not an Emergency Medical Service

THIS SERVICE IS NOT FOR MEDICAL EMERGENCIES. If you are experiencing a medical emergency, CALL 911 OR GO TO YOUR NEAREST EMERGENCY ROOM IMMEDIATELY. Our Functional Aesthetics Consultation is intended for non-emergency wellness, aesthetic, and preventive health evaluations only.

6. Scope of Services — What’s Included and What’s Not

Included in the Consultation

  • A detailed review of your symptoms, skin concerns, and wellness goals

  • Insight into possible root causes (hormones, gut health, inflammation, metabolism)

  • A personalized plan designed to enhance aesthetic results from the inside out

  • Discussion of available services including weight loss injection plans, peptide therapy, bio-identical hormone replacement therapy (BHRT/Pellet), and personalized supplement protocols

Not Included

  • Diagnostic laboratory testing (may be recommended and ordered separately)

  • Prescriptions or initiation of treatment (require full clinical intake and physician evaluation)

  • Aesthetic procedures (quoted and scheduled separately through Image District)

  • Insurance billing — all services under this program are cash-pay only

7. No Guarantee of Results

The HealthSpan Method™ and all related protocols — including weight loss injection plans, peptide therapy, BHRT, and supplement plans — are individualized clinical frameworks. We make no representations or guarantees regarding specific outcomes, including weight loss, skin improvement, hormonal balance, energy levels, or aesthetic results. Individual outcomes vary based on health status, compliance, lifestyle, age, and other factors.

Testimonials, client outcomes, and before/after examples shared in our marketing materials reflect individual experiences and are not representative of all clients or all conditions.

8. Cash-Pay Acknowledgment

By booking through this funnel, you acknowledge that:

  • All services under the Functional Aesthetics program are offered on a direct cash-pay basis

  • We do not bill insurance, Medicare, or Medicaid for services offered through this program

  • You are responsible for understanding and meeting your financial obligations before or at your appointment

  • A good-faith estimate of anticipated costs beyond the consultation fee will be provided upon request, consistent with the No Surprises Act (42 U.S.C. § 300gg-111 et seq.)

9. Informed Consent for Clinical Services

If you proceed to clinical treatment with Complete Health & Wellness following your consultation, you will be asked to review and sign a formal Informed Consent document prior to any treatment. That document will detail the specific risks, benefits, and alternatives of the recommended treatment(s). Agreeing to these Terms does not substitute for formal clinical informed consent.

10. Communications Consent

By submitting your information and booking a consultation, you consent to receiving appointment confirmations, reminders, pre-consultation instructions, and follow-up communications via email, phone, or SMS from Image District and/or Complete Health & Wellness. Standard messaging and data rates may apply. You may opt out of marketing communications at any time by replying STOP to any SMS or clicking unsubscribe in any email. Appointment-related communications will continue as necessary.

11. Intellectual Property

All content, materials, methodologies, trademarks, and frameworks — including The HealthSpan Method™, the 8-pillar wellness framework, and all associated program content — are the exclusive intellectual property of their respective owners. You may not reproduce, copy, distribute, or create derivative works from any program content without prior written permission. Attending a consultation does not grant any license to our intellectual property.

12. Representations and Warranties

By booking a consultation, you represent and warrant that:

  • You are at least 18 years of age

  • All information you provide is accurate, complete, and truthful

  • You are booking for yourself or a person for whom you have legal authority

  • You understand this is not a substitute for emergency care or a full medical evaluation

  • You have no medical condition that would make participation in a wellness consultation inappropriate without prior physician clearance (and if so, you will disclose this at booking)

13. Limitation of Liability

To the fullest extent permitted by applicable law, Complete Health & Wellness, Image District, and their respective officers, physicians, staff, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our Services, reliance on information provided in the consultation or on our websites, or any inability to complete a booking or appointment.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the consultation shall not exceed the amount you paid for the specific consultation giving rise to the claim.

Nothing in this section limits liability for gross negligence, willful misconduct, fraud, or claims that cannot be limited under applicable Texas law or federal medical standards.

14. Indemnification

You agree to indemnify, defend, and hold harmless Complete Health & Wellness, Image District, and their respective affiliates, physicians, staff, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your provision of false or misleading information; or (d) your violation of any applicable law or third-party right.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall first be addressed through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Fort Bend County, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

16. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any executed Informed Consent documents, constitute the entire agreement between you and us with respect to the Functional Aesthetics Consultation program.

17. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our respective websites with a revised effective date. Continued use of our Services after any update constitutes your acceptance of the revised Terms.
